Accessia Health (“Company,” “us”, “our,” or “we”) respects your privacy and is committed to protecting it through our compliance with this privacy policy (the “Privacy Policy”).

This Privacy Policy describes:

  • the types of information we may collect or that you may provide when you visit our website at accessiahealth.org (the “Website”);
  • the types of information we may collect or that you may provide when you register an account for, access, or use our patient portals (the “Portals”); and
  • our practices for collecting, using, maintaining, protecting, and disclosing such information.

This Privacy Policy applies only to information we collect through the Website and Portals and in email and other electronic communications sent through or in connection with the Website or Portals on which it is posted (collectively, the “Services”). This Privacy Policy does not apply to information that we collect from any other source, including any third-party websites you may access through the Services. These third-party websites may have their own privacy policies, which you should read before providing information on or through them.

Please review this Privacy Policy carefully. If you do not agree with our practices or the terms of this Privacy Policy, do not access, register an account with, or use the Services. By accessing, registering an account with, or using the Services, you agree to this Privacy Policy.

Accessia Health may update this Privacy Policy from time to time. The date the Privacy Policy was made effective and last updated is identified above. Your continued use of the Services after we revise this Privacy Policy means you accept any changes or updates, so please check this webpage periodically for updates, as they are binding upon you.

 

2. How Do We Collect Information?

When you access, register an account with, or use the Services, we may collect information that relates to an identified or identifiable natural person (“personal information”).

You Directly Provide Information to Us

When you register an account with or use the Portals or Website, you may provide certain information that identifies you, which includes:

  • Information that you voluntarily provide when registering an account for the Portals, filling out forms in the Portals, and requesting and/or subscribing to our Services, such as: your first and last name, mailing address, email address, telephone number, birth date, driver’s license or passport, or other identifiers by which you may be identified or contacted. You may also provide such information via our Website when using our “chatbot” and other chat features described herein.
  • Professional or employment-related information.
  • Records and copies of your communications with us.
  • Financial information, such as income and tax information. You may also provide financial information such as your credit card information when you donate through our Website, which may be processed by our third-party vendor as described herein.
    • When you make an online donation, we may collect personal information such as your name, billing address, credit card information and email address. This information is used to acknowledge receipt of your donation for tax purposes. If you choose to send a donation in honor or in memory of someone and request that an acknowledgement be sent to another individual, we will use the name and email or mailing address of that individual for acknowledgement purposes only.
  • Personal Health Information as that term is defined under applicable law, which is subject to our Notice of Privacy Practices (here).
  • Healthcare provider and insurance information.

We Automatically Collect Information

When you access and use the Services, we may use cookies, pixels, or similar technologies to automatically collect details about: (1) your access to and use of the Services; (2) your device and internet connection, including your device’s unique device identifier, operating system, and browser type; and (3) information about the location of your device.

If you do not want us to collect this information, do not access or use the Services. While you may opt-out of the collection/sharing of certain information in the Services, please note that certain features of the Services may not function properly should you opt-out.

  • Cookies: We use “cookies” (small text files stored locally on your devices) to help us improve your access to and use of the Services, including to enhance our digital advertising efforts through the Services which may include targeted advertising cookies set by third-party advertisers. Any targeted advertising cookies do not directly store personal information that identifies you such as your name or date of birth, but rather limited information about your web-browsing behavior. Cookies can also enable us to track and target the interests of users of our Services to enhance the experience on our Website and in the Portals. Most internet browsers have configuration settings to disallow the acceptance of cookies. However, setting a browser to reject cookies may, in certain instances, prevent you from taking full advantage of the Services.  Certain third parties such as our payment processors may also require that you accept certain cookies to work properly.   You may control your online targeted advertising preferences and opt out from having your data processed by certain advertising and marketing companies by setting your browser to block any such cookies, or by visiting the applicable third parties’ websites.
  • Chatbot: The Services also feature a “chat bot” and other chat features, the usage of which may result in the collection of certain personal information by us and/or our third-party vendors provided by a user in order to support the use of our Services. A user’s interactions with a chatbot or chat feature, including any information shared, may be recorded and analyzed for training purposes and used to improve services rendered. By using any chatbot or chat feature and voluntarily submitting personal information, you consent to the use of such information as described herein. If you voluntarily chose to provide personal information through our chat features that constitutes PHI, our collection and use of such information will be subject to Accessia Health’s Notice of Privacy Practices.
  • Google Analytics: We and/or our vendors may also use a tool called “Google Analytics” to collect information about your use of the Services. Google Analytics collects information such as how often users visit the Website, what pages they visit when they do so, and what other websites they used prior to coming to the Website. We use the information received from Google Analytics to improve the Services, which does not include personal information that identifies you (rather, Google Analytics collects only the IP addresses, and we do not combine the information collected through the use of Google Analytics with personal information). We recommend that you review the Google Analytics Terms of Use and the Google Privacy Policy.

Sensitive Information

Some of the personal information that you provide to us or that we collect from you when you use the Services may be considered “sensitive” personal information under applicable laws.  By providing such information and accessing and using the Services, you explicitly consent to our collection and use of such personal information solely for the purposes described herein.

Third-Party Information Collection

We may also collect personal information from third parties, including recruiters, credit reporting agencies, counterparties in a transaction, etc. When you use the Services, certain third parties such as our payment processing vendors and the third parties that supports our chat features may collect information from you on our behalf.  We recommend that you carefully review the privacy policies of any third parties before providing any personal information.

 

3. Children and Minors

The Services do not target and are not intended for children as defined under applicable law. We do not knowingly collect personal information from minors and only collect information regarding minors when submitted by a parent or guardian. If we learn we have collected or received personal information from a child without verification of parental consent, we will delete that information. 4. How Do We Use Information?

We may use personal information that we collect about you or that you provide to us to:

  • Provide the Services and any other information, products, or services that you request from us, and to complete requested transactions (e.g., to process donations).
  • To create and maintain your user account for the Portals which require you to log in, including to provide notices about your account and to communicate with you.
  • Fulfill any other purpose for which you provide it.
  • Carry out our obligations and enforce our rights arising from any contracts entered into between you and us.
  • Store information about your preferences, allowing us to customize the Portals according to your individual interests, and recognize you when you use or sign into your account with us.
  • Collect and process applications for employment.
  • To understand usage patterns and any issues with the Services, and to improve the Services.
  • We do not sell or share users’, including donors’, personal information with any other third parties except as described herein, nor do we send mailings to our donors on behalf of other organizations.

 

5. How Do We Share/Disclose Information?

We may disclose personal information that we collect or that you provide:

  • To our subsidiaries and affiliates.
  • To contractors, service providers, and other third parties we use to support our business, including payment processors to allow you to complete a donation via the Website.
  • To a buyer or other successor in the event of a merger or other sale or transfer of some or all of the Company’s assets.
  • To fulfill the purpose for which you provide it and/or for any other purpose disclosed by us when you provide the information.
  • With your consent.
  • For legal purposes, including to investigate fraudulent use or other misuse of the Services and to comply with any court order, law, or legal process, including to respond to any government or regulatory request.
  • To enforce our rights arising from any contracts entered into between you and us, as applicable.
  • If we believe disclosure is necessary or appropriate to protect the rights, property, or safety of the Company, our customers, or others.
  • With health care providers, pharmacies and pharmacy benefit managers, insurance companies, and similar third parties to process health claims, and with other third-party vendors to validate income and health insurance information, to process payments, and otherwise when you have specifically requested that we do so or if you have requested certain services from us. We will not otherwise share your personal information with such third parties.

We do not sell personal information for monetary consideration. We and our third-party advertising partners may use cookies to collect information from visitors of the Services for targeted advertising purposes as described in Section 2 of this Privacy Policy.  You may choose to opt-out of such targeted advertising cookies by adjusting your browser’s settings.

 

6. How Do We Retain & Secure Information?

We retain personal information for legitimate business purposes and to meet legal and regulatory requirements and in accordance with our retention policy.

We have implemented and maintain reasonable measures designed to secure your personal information from unauthorized access, use, alteration, and disclosure. However, we cannot guarantee that the transmission of information via the internet or our Services is 100% secure. Thus, any transmission of personal information is at your own risk. We are not responsible for circumvention of any privacy settings or security measures we provide.

You may select or be issued a username and password when you register an account with us in connection with the Portals. You are responsible for keeping your usernames and passwords confidential, as you are responsible for any access, use, or activities on the Services in or through your account.

 

7. What Are My Choices?

We provide you with the following choices regarding your personal information that we collect or that you provide to us in connection with the Services:

Opting Out of Certain Uses of Your Personal Information

  • You can set your browser to refuse all or some browser cookies, or to alert you when cookies are being sent. If you disable or refuse certain cookies, some parts of the Services may then be inaccessible or not function properly. For example, if you check the “remember me” option when you log into your user account for the Portals, your security information is recorded in a cookie so that you do not have to log in every time you access the Portals. We also use cookies to keep track of how often we require you to use two-factor authentication and to confirm whether you are currently logged in to your user account.  We also use cookies for purposes of delivering targeted advertisements, and you may opt-out of the use of cookies for this purpose by adjusting your browser’s settings to block these cookies.
  • Location Information. You can choose whether or not to allow the Website or Portals to collect and use geographic information about your device’s location (such as your city and state, but not your precise geographic location). If you block the use of location information, some features of the Services may not function properly.

Accessing, Correcting, & Deleting Your Personal Information

You can review and update certain personal information that you provide to us by signing into your account and updating such information in the Portals/your user dashboard.

Other Rights

You may also request a copy of the personal information that we have collected from you and/or request that we transfer your personal information to you or another organization, under certain conditions. We will not discriminate against you if you exercise any rights under this Privacy Policy.

9. Users of the Services Outside the United States

Any personal information provided on or through the Services is stored and processed in the United States. If you access the Services from a location outside of the United States, please be aware that the laws in the United States may not offer the same degree of privacy protection as the laws in your jurisdiction. We do not knowingly collect personal information about individuals residing in the European Union.
